Denza Trademark Dispute: BYD Loses to PT Worcas in Central Jakarta Commercial Court, Ordered to Pay Court Fees

TIMESINDONESIA, JAKARTA – Chinese electric vehicle giant BYD has lost its trademark dispute over the name DENZA in the Central Jakarta Commercial Court. The court ruled in favor of PT Worcas Nusantara Abadi, rejecting BYD’s claims in full and ordering the company to pay court fees totaling IDR 1,070,000.

The dispute arose after BYD began marketing its premium electric vehicles under the DENZA brand in Indonesia on January 22, 2025. However, it was later revealed that PT Worcas had already registered the DENZA trademark on July 3, 2023, under registration number IDM001176306, granting it legal protection until July 3, 2033. BYD, by contrast, only filed its trademark application in Indonesia on August 8, 2024.

Filed under Case No. 1/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst, BYD’s lawsuit sought official recognition as the rightful owner and registrant of the DENZA brand and its variants globally. 

The company also requested the court to recognize DENZA as a well-known mark, claimed substantial similarity with PT Worcas’s registered trademark in Class 12, accused Worcas of registering the name in bad faith, and sought the cancellation of the existing registration.

Following 117 days of proceedings, the panel of judges ruled to dismiss BYD’s claims entirely. As stated in the official ruling published on the SIPP website of the Central Jakarta District Court, BYD was also ordered to pay court costs amounting to IDR 1,070,000.

In response to the ruling, PT Worcas Nusantara Abadi’s Legal Manager, Arfian Syahputra, SH., expressed appreciation for the outcome and reaffirmed the company’s commitment to the legal process. 

“We respect the legal process in Indonesia and believe this ruling reflects fairness and transparency. However, we regret the spread of misleading reports that have potentially damaged the reputation of Worcas Group during the course of this case,” Arfian 

As of publication, BYD has not released an official statement. It remains unclear whether the company plans to appeal the decision. (*)
